Ban Corporal Punishment North Carolina
An open letter to members of the North Carolina Legislature

Dear North Carolina Legislator:

A 12-year-old schoolboy was punished for misbehavior. A male teacher, about twice the child's size struck him five times on the buttocks with a wooden board. That afternoon, in response to an urgent call from the boy's sister, the mother left work and rushed home to find out what had happened to her son. She was horrified and outraged by appearance of the massive bruises he had sustained. She took him to the E.R. where he was treated and his injuries documented. Police were notified and took numerous photos. The mother also went to the school and showed the principal, the guidance counselor and the teacher who inflicted the punishment the effects of their discipline policy on her son's body.

We are not describing an event that took place in the distant past or in some remote, backward region of the globe. This happened on September 12, 2005, in Rowland Middle School, Robeson County, North Carolina.

Had this teacher used the same amount of force against any adult for any reason other than self-defense, he most certainly would have been charged with a felony. But having done this to a schoolchild, he was only suspended from his teaching duties for one day while the matter was investigated. The District Attorney took the position that the teacher acted within the law and therefore couldn't be charged.

Anyone who is tempted to dismiss this incident as a rare event should be reminded that according to the last published statistics by the Office of Civil Rights, 5,717 students, including children with disabilities, were paddled in North Carolina in the short time frame of 180 days of school. Since those stats are self-reported, they are most likely underreported. Injuries to paddled children are all too common, but because children tend to be secretive about that area of their anatomy, most escape attention.

But not all injuries go unreported. Typical examples of schoolchildren's punishment-related injuries can be viewed online at www.nospank.net/violatn.htm and www.nospank.net/a7-05.pdf. The parents of those injured children have allowed the images of their injuries to be made available for the public record, and some have sued the involved teachers and their employers. As more parents become better informed about the physical and psychological short- and long-term dangers of corporal punishment, more such lawsuits are being filed and are succeeding. A concurrent trend in the states that still allow corporal punishment in schools has been the banning of it district by district, if not for the right reasons, then out of pure economic self interest.

On January 22, 1871, a New York Times editorial stated:

"... It is exceedingly unsafe to leave too wide a discretion in their hands. The nature even of instructors of youth is fallible, and there is a kind of intoxication in the exercise of unlimited power, though it be only over little boys and girls, that may wisely be checked and controlled."

Today, 134 years later, we believe it's due time North Carolina heeded that wise editor's warning. The scholarship of the past half century and the good example of well-run education systems in the 29 paddle-free states prove conclusively that corporal punishment is counterproductive, fraught with risks and has no place in any school system in the civilized world.

A full discussion of what's wrong with corporal punishment isn't within the scope of this letter, nor should it be necessary. That information is abundantly available, and any literate person with access to a computer can become an expert on the subject in two or three evenings. Only among the uninformed are arguments favoring corporal punishment taken seriously. There is not one teachers' college in North Carolina that teaches undergraduates the correct method for hitting children, and every reader of this letter knows why.

Surely, the great majority of teachers of North Carolina, having been trained as professionals, are eager and prepared to perform as professionals. They know that beating and bruising children's buttocks does not fit their job description.

THEREFORE, we, the undersigned, urge the immediate banning of corporal punishment in all schools of North Carolina.
