Sex accusations emerge in case against former daycare director

Details of the sex crime a former Topeka church daycare director is accused of committing against a 7-year-old girl came out in court Tuesday.

Timothy McHenry was arrested a little more than a year ago, accused of aggravated indecent liberties with a child. He’s been out on bond ever since.

Police said the alleged sex crime happened at Christ the King Church, where McHenry ran the after-school daycare.

In testimony, the girl said she would often go to McHenry’s office at the church to read books. But one day when they were done reading, she said “Mr. Tim” took her into a meeting room to play the “spanky” or “spanking” game.

“He would get a chair and he would sit down and I would lay on his lap,” she said. “If I untied his shoe, he would pull my pants down (and spank me) on the underwear. If I would untie his other shoe, he would tap me on the bare bottom.”

It was a game the girl testified she played with McHenry more than once.

Donald Hoffman, McHenry’s defense attorney, said testimony will show the girl’s story has “become a part of her false memory.”

Hoffman said McHenry took the girl to see if the room had been set up for a meeting that was being held later that night and they immediately left.

Several people from Christ the King, as well as the girl’s parents, also testified Tuesday.

More than a dozen of McHenry’s friends and family were in court.

The case is expected to wrap up by the end of the week.
